Terms of Service:
HomeDomains.net strives to provide the best possible service to all of our customers, but we will not tolerate any unlawful activity or abuse on our servers and we retain the right to accept or reject client provided content that we deem to be socially unacceptable. We respect freedom of speech and expression unless it is potentially hurtful or harmful to others. These brief guidelines are imposed to protect you, other HomeDomains.net customers and us against such harm.

HomeDomains.net is not responsible or liable for the content of any Web page hosted by HomeDomains.net. HomeDomains.net does not preview, screen, review, monitor or manage any data, information, image, video or other materials that may appear on the Web pages hosted by HomeDomains.net.

Terms of Use:
Home Domains.net PropertySites may only be used to ethically represent residential and/or commercial real estate that is for sale or rent. Each PropertySite license may be used to represent one unique property during the time period that the license is valid. The PropertySite license may not be re-used for another property. Each unique property requires the purchase of an additional PropertySite license. PropertySite licenses are valid for a period of one year from the date of publishing.

HomeDomains.net PropertySites can only be created and published by registered individuals, organizations or business entities. Registration requires the user to provide legitimate contact information and a unique email address. Changes to a registered user’s profile can only be made by the owner of the unique email address used during the registration process.

Each PropertySite license held by a registered user is owned by the individual or organization that paid for the license. PropertySite licenses are not transferable.

Domain names purchased from HomeDoamins.net are the property of the purchasing individual or entity.

Overweb3D (www.overweb3d.net) video service plans are purchased from and managed by NuMedia Ventures, Inc. and not by HomeDomains.net.

HomeDomains.net reserves the right to permanently delete any PropertySite within 90 days of expiration. A PropertySite license is valid for a period of one year from the date of publishing. A PropertySite will expire on the first day after the anniversary date of publishing unless the customer elects to extend the PropertySite license.

Payment Policies, Fees, Refunds and Terms of Agreement:
Full payment is required before any PropertySite is published to the Internet. All payments are due in advance of service and payments must be made electronically using an approved credit card or PayPal. We do not accept checks as a method of payment. No bills or invoices will be sent by postal mail or fax.

You may cancel your account at anytime, but as a strict policy, we do not offer credits or refunds for PropertySites that have already paid for and published. IF YOU DECIDE TO CANCEL AFTER PAYMENT IS RECEIVED, YOU WILL NOT RECEIVE A REFUND.

If you have questions, comments or concerns about your HomeDomains PropertySite, you must contact us by electronic mail within 60 days of payment. AFTER 60 DAYS ALL PAYMENTS ARE FINAL, NO EXCEPTIONS.

If cancellation is done by HomeDomains.net due to violation of these Terms and Conditions, there will be no refund of any kind. All notices of suspension or cancellation of services will be sent by electronic mail. All monetary transactions are in US dollars.
Additional features can be added at any time. HomeDomains.net reserves the right to change prices at any time, without notice.

Absence of Warranty:
By your acceptance of these Terms and Conditions you understand and agree that you agree to use all HomeDomains.net products, services and features at your own risk. HOMEDOMAINS.NET DOES HEREBY DISCLAIM ANY AND ALL WARRANTIES, INCLULING, BUT NOT LIMITED TO, THE WARRANTY OF MERCHANTABILITY AND THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.

Indemnification Policy:
In no event shall HomeDomains.net be liable for any loss, loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. User agrees to defend, indemnify, save and hold HomeDomains.net harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees, consultant fees incidental to all demands, liabilities, losses, costs and claims asserted against HomeDomains.net, its parent company, subsidiaries, agents, affiliates, customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed, or are incidental thereto, or any product or service sold by customer, it's agents, affiliates, employees or assigns, or are incidental thereto. Without limiting the generality of the foregoing, Customer agrees to defend, indemnify and hold harmless HomeDomains.net against liabilities arising out of:
  1. any injury to person or property caused by any products or services sold or otherwise distributed in connection with HomeDomains.net products or services;
  2. any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
  3. any alleged or actual copyright infringement resulting from the use of the audio, video graphical or textual content provided by the Customer or developed at the request or direction of the Customer. and
  4. any defective products sold by Customer using HomeDomains.net products or services.
Content Policy:
As the author of any and all Web pages hosted by HomeDomains.net, the user is fully and solely responsible and liable for the content of all such Web pages.

ANY AND ALL HOMEDOMAINS.NET SERVICES PROVIDED SHALL BE USED FOR LAWFUL PURPOSES ONLY AND SHALL NOT BE USED BY ANYONE TO POST, PROPOAGATE, DISTRIBUTE, PUBLISH, HOUSE, STORE, SOLICIT, PROCESS, TRANSMIT OR OTHERWISE HANDLE ANY OF THE FOLLOWING:
  1. Obscene Material, Pornography and sexually-related material, services, products, merchandising or content are strictly prohibited on all HomeDomains.net servers. This includes content that may infer sexual content, or links to adult content elsewhere. HomeDomains.net will be the sole arbiter in determining violations of this provision;
  2. Discriminatory or Harassing Material, which includes, but is not limited to, any material that is discriminatory or harassing in any manner, whether based on race, gender, age, national origin, religion, sexual orientation, marital status, disability or any other basis, or any material that is otherwise harmful, offensive, threatening, abusive, embarrassing, distressful, insulting, vulgar, hateful, disparaging, or otherwise objectionable and in violation of any applicable laws;
  3. Defamatory Material, which includes, but is not limited to, any material that is disparaging, slanderous, libelous, or otherwise defamatory and in violation of any applicable laws;
  4. Fraudulent Material, which includes, but is not limited to, any material that consists of fraudulent data or information that the user believes or has reason to believe is false and is intended to be relied upon by others;
  5. False Advertising, which includes, but is not limited to, any advertising, marketing or promotional data, information or materials that contain any deceptive, misleading and/or false representations, statements, claims, assurances, or messages;
  6. Violations of Intellectual Property Rights, which includes, but is not limited to, any material that infringes upon another persons intellectual property rights, including copyright, trademark, trade secret, trade dress, patent, service mark or any other electronic or intellectual property right belonging to another person or entity;
  7. "Spam", which includes, but is not limited to, transmitting unsolicited mail to another person or entity, including unsolicited e-mail marketing and sending large volumes of unsolicited e-mail to another individual or entity;
  8. Systems Abuse, which includes, but is not limited to, abuse of HomeDomains.net servers, attacks on servers, hack attacks, port scanning or probing, materials, conduct or activity that invades any third party's right to privacy, or harmful materials, conduct or activity that prevent other users from effectively using the system;
  9. Illegal Material, which includes, but is not limited to, any material that is illegal, encourages illegal activity or in any manner violates any international, federal, state or local laws or regulations;
  10. Unacceptable Material, which includes any conduct, data, e-mail, information, content or activity that HomeDomains.net, at its sole and absolute discretion, deems to be unacceptable use of the Services provided by HomeDomains.net.
We reserve the right to refuse service to anyone for any reason not prohibited by law. Also we reserve the right to terminate service to any customer for any reason not prohibited by law. HomeDomains.net reserves the right to suspend or terminate any user's account if it determines, at its sole and absolute discretion that the user is in violation of these Terms and Conditions.

Copyright Violations:
The Digital Millennium Copyright Act ("DMCA") sets forth the law regarding the use of copyrighted materials on the Internet. All HomeDomains.net customers are subject to the requirements of the DMCA. Individuals or entities submitting notifications of alleged copyright infringement by a HomeDomains.net customer (per the DMCA) to HomeDomains.net must follow the procedures here.

Minimum Age Requirement:
HomeDomains.net customers must be at least 18 years of age. Any individual under the age of 18 years (“Minor”) must have a parent or legal guardian agree to these Terms and Conditions in order for the Minor to become a HomeDomains.net customer. A parent or legal guardian who accepts the Terms and Conditions on behalf of a Minor will be primarily liable for ensuring complete and proper compliance with the Terms and Conditions, including the timely and full payment of the charges for HomeDomains.net services, and such primary liability will continue even when the Minor has attained the age of 18, unless the parent or legal guardian obtains HomeDomains.net’s express written consent to the contrary. Any acceptance of the Terms and Conditions or any other agreement for HomeDomains.net services will be deemed null and void to the extent that HomeDomains.net will not be liable in any way as a result of the Minor's age or legal incapacity or the Minor's use of HomeDomains.net services.

Governing Law and Severability:
The Terms and Conditions for HomeDomains.net services will be governed by and construed in accordance with the laws of the State of Illinois without reference to its conflicts of laws principles. Any litigation or arbitration between a customer and HomeDomains.net will take place in the Northern District of Illinois, and the customer will consent to personal jurisdiction and venue in that jurisdiction. If any provision or portion of the Terms and Conditions is found by a court of competent jurisdiction to be unenforceable for any reason, the remainder of the Terms and Conditions will continue in full force and effect.

Force Majeure:
HomeDomains.net will not be liable for delays in its performance of the Terms and Conditions or HomeDomains.net services caused by circumstances beyond HomeDomains.net’s reasonable control, including acts of God, wars, insurrection, civil commotions, riots, national disasters, earthquakes, strikes, fires, floods, water damage, explosions, shortages of labor or materials, labor disputes, transportation problems, accidents, embargoes, or governmental restrictions (collectively "Force Majeure"). HomeDomains.net will make reasonable efforts to reduce to a minimum and mitigate the effect of any Force Majeure. Notwithstanding anything contained elsewhere herein, lack of finances will not be considered an event of Force Majeure nor will any event of Force Majeure suspend any obligation of customers for the payment of money due.

Backups:
Full backups are made weekly, and backups of new/changed data made daily. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the client's responsibility to maintain local copies of their content or any other information. If loss of content occurs due to an error of HomeDomains.net, we will attempt to recover the data at no charge to the client.

HomeDomains.net reserves the right to amend these Terms and Conditions at any time and without notice.

HomeDomains.net will be the sole arbiter as to what constitutes a violation of these Policies.
